THE 180 NIGHT BUY-BACK PLAN

  1. Is only available to residents who reside in South Africa.
  2. Is only available on our TEMPUR range of mattresses and adjustables.
  3. Is only available for our standard size mattresses excluding our sensation Deluxe 27cm mattress.
  4. Only applies to our adjustable’s if they are ordered together with a TEMPUR mattress.
  5. Is not applicable in the event of death.
  6. Is NOT available on any demo-items, sale items but can be used on Promotions running in store.
  7. Is NOT available for Overlays, Bed Frames, Pillows and Accessories (including, but not limited to: lumbar supports, travel pillows, travel sets or linen) or any products which have been customised by us, in any way, or have been made to meet the Customer’s particular requirements.
  8. In order for this contract to be applicable, you the customer, must purchase a TEMPUR mattress Protector at the time of purchase and commit to keeping the product, purchased, in a clean condition devoid of any damage or marks.
  9. You will need to register your product guarantee on za.tempur.com for the contract to be valid.
  10. Will incur a 15% penalty fee on the product purchase price, as reflected on the invoice, when requesting a refund on any and all of the above mentioned products and in compliance with the terms and conditions.
  11. The 180 Night Buy-Back plan excludes Collection / Delivery fees.
  12. Delivery and Installation of the goods must be done by our approved installer.

 PERIOD 

  1. The 180 Night Buy-Back plan period will commence from the date on which the products are delivered to the customer and will end at midnight on the 180th day after that date.
  2. A minimum of 60 nights must be completed before the money back guarantee becomes applicable.  This is the required period, as per international guidelines, in order to adapt to the products.

 EXCHANGE TERMS 

  1. Should you, the Customer, prefer a different feel of mattress then you will be allowed one. This exchange can only take place if you have been on the mattress for a minimum of 60 nights.
  2. To start your exchange process, please contact your sales consultant or your nearest store.
  3. Exchanges are only applicable on TEMPUR Mattresses and TEMPUR Adjustables.
  4. An inspection fee of R850.00 (minimum), depending on your area will need to be paid first.
  5. We will then come out to do an inspection of your current product. If there are any marks or stains or if your mattress is found to be in an unacceptable condition, the exchange process can’t continue.  The delivery fee will be forfeited and the contract will no longer be applicable.
  6. Minimum delivery fee of R850 (depending on your area) will be charged and will need to be paid before the exchange takes place – as per item 4 (above).
  7. Price differences on upgrades will be charged, and no current promotions will be valid. You will be notified of any upgrade fees in writing and your consultant will contact you, for payment before the exchange can take place.
  8. Please allow for 8 working days for an exchange to take place – from date of payment.
  9. Please note, once you have exercised the right and done the exchange, this contract will become null and void. No further exchanges or refunds will be allowed.

 RETURN TERMS 

  1. Should you, the Customer wish to take up the 180 Night Buy-Back plan, you can request the product to be sent back to us by either emailing orders@pharmaline.co.za or contacting your sales consultant, alternatively you can complete a Return Request form online on vencasa.co.za/return-policy.asp.
  2. An inspection fee of R850.00 (minimum), depending on your area will need to be paid first.
  3. Should you be in further lying areas where an inspection from us is not possible you will be requested to take photographs. Please note that these photographs of the mattress and adjustable’s are to be sent to us via email in order to assess the mattress and adjustable for damage and cleanliness. Please ask you consultant for the process of taking pictures for the buyback to be approved. These pictures are required within 7 days of receiving the 180 Night Buy-Back request with all the necessary documentation. Inspection by Pharmaline / Vencasa will also take place before final approval is given.
  4. The cost of packaging it and returning it to us is for your own account. Should you require us to arrange this, we will provide a quotation to do so.
  5. Upon receipt of the returned product, we will refund you up to 85% of the original purchase price.
  6. The refund will be affected within 10 - 14 business days of receipt of the product at the Pharmaline / Vencasa Johannesburg distribution hub.
  7. An email on the breakdown of your refund will be sent to you as well as your consultant. Your Consultant will call you with the breakdown of your refund amount.
  8. You will need to sign the letter and send it to us with your banking details.
  9. The products will be picked up (8 working days) and checked on the spot to evaluate the condition.
  10. If any marks or stains are found or if the mattress or products are found to be in an unacceptable condition, the contract will become null and void and you will not get an exchange or refund.
  11. No claim on interest, relating to the funds used, on the purchase can be made.
  12. You will be charged a Collection Fee of R850 (depending on your area) which will be taken off your refund amount.
  13. Any added value promotional items (free products) received by the Customer, will be deducted from the 180 Night Buy-Back value and retained by the Customer. Exception will be given to unopened items still in their original packaging, in which case, they can be returned.
  14. Due to their hygiene factor, pillows, mattress protectors and bed linen are non-refundable.
  15. Once you have exercised the right to do a refund, this contract becomes null and void.

DEFECTIVE GOODS

  1. Defective goods will be repaired or replaced, subject to individual product warranty and guarantee.
  2. If your product is defective or you are unsure if it is defective, email orders@pharmaline.co.za or contact your sales consultant to initiate an inspection, or complete a Return Request Form online on www.vencasa.co.za/return-policy.asp.
  3. Please note that we may require photographs of the item to be sent to us via email, in order to do an assessment. Onsite inspections may be charged a call out fee of R850 (depending on your area).

GENERAL TERMS AND CONDITIONS

  1. Nothing in this agreement will confer any third-party benefit or right to enforce any terms of this agreement, except when expressly agreed to between both parties. If the Customer intends to pass the goods onto someone else, or as a gift or otherwise, the Customer must note the name and address or the person on the invoice, to enable that person to have the benefits or rights to enforce any terms of this contract all within the stipulated time period as per the contract.
  2. The Customer acknowledges that they are aware that it is not guaranteed that the goods sold will cure or alleviate any illness or ailment or be appropriate treatment for it.
  3. If the Customer intends to purchase goods for a use not approved by the manufacturer in the user manual, he/she must use their own skill and judgement, or that of an independent advisor in deciding whether they are suitable.
  4. Pharmaline / Vencasa will endeavour to deliver the goods within 8 days, but the delivery time is approximate and Pharmaline / Vencasa is not liable for delays caused by circumstances beyond their reasonable control. Examples include: strikes, war, supplier, transport, production problems and natural disasters.
  5. Pharmaline / Vencasa cannot be held responsible for any loss, damage or injuries arising from the purchase of this product.
  6. Should a purchase be cancelled prior to delivery, any deposit paid to the seller is refundable (excluding customised items which are non-refundable).
  7. Should Pharmaline / Vencasa choose not to enforce its rights in terms of this agreement, this shall in no way be deemed to be a waiver by Pharmaline / Vencasa of their rights under this agreement.
  8. This contract between the Customer and Pharmaline / Vencasa is governed by the laws of South Africa and any dispute between the parties will be resolved exclusively by the courts of South Africa.
  9. This contract comprises the whole agreement between the parties. No variation of, cancellation, or addition/deletion/waiver to this agreement shall be valid unless put in writing and signed by both parties.
  10. Repairs or exchanges of the product, or this period do not alter or extend the guarantee.
  11. The TEMPUR guarantee is subject to registering your products on za.tempur.com
  12. Should any product be delivered in a soiled or damaged state, the onus is on the customer to inform Pharmaline / Vencasa immediately.
  13. We regret that we are unable to take away or dispose of your old mattress.
  14. Once you have exercised your right do either an exchange or a refund, this contract will become null and void.
  15. You may either do an exchange, or a refund but not both.
  16. If you have purchased 2 single mattresses, you are entitled to exchange the mattresses at different times during the 180 Night Buy-Back period.
